These Terms & Conditions (“Terms”) govern your use of Berkshire EA Tax Advisors’ services, website, client portal, intake forms, and any documents you submit to us. By engaging our services, you agree to these Terms.
- Scope of Services
Berkshire EA Tax Advisors provides:
- Individual and business tax preparation
- Tax planning and consulting
- IRS and state tax representation
- Document review and support services
We do not provide legal or investment advice.
- Client Responsibilities
You agree to:
- Provide complete, accurate, and timely information
- Upload all required documents
- Review your tax return before signing
- Notify us of any IRS/state notices immediately
- Maintain your own copies of personal documents
We are not responsible for delays due to missing or incomplete information.
- Accuracy of Information
We rely on the information you provide.
We are not responsible for errors resulting from:
- Missing documents
- Incorrect or incomplete information
- Failure to disclose income or tax situations
You are ultimately responsible for the accuracy of your return.
- Refunds & Payments
All payments for tax preparation are final once work has begun.
Refunds are not provided for:
- Changes in your tax situation
- Disagreements with legal tax outcomes
- IRS balances due
If payment plans are offered, you must complete all scheduled payments.
- Electronic Signatures & Communications
By signing electronically, you authorize:
- E-file submissions
- Digital release forms
- Electronic communication
- Secure file storage
Email, text messages, and electronic communication may not always be encrypted.
- Turnaround Time
Normal turnaround time depends on workload and document completeness.
Urgent or rush services may incur additional fees.
- Representation & IRS Communication
We may provide IRS or state representation only if you sign Form 2848 or 8821.
Without this authorization, we cannot speak to the IRS on your behalf.
- Limitation of Liability
Berkshire EA Tax Advisors is not liable for:
- Penalties or interest resulting from client errors
- Identity theft incidents
- Software outages, delays, or electronic filing system failures
- Missed deductions not disclosed by the client
Our liability is limited to the amount paid for the service in question.
- Confidentiality
We maintain strict confidentiality in compliance with:
- IRS Publication 4557
- Internal Revenue Code §7216
- Gramm-Leach-Bliley Act (GLBA) Standards
We will not disclose your information without your consent unless required by law.
- Termination of Services
We may terminate services if:
- You fail to provide required documents
- You behave disrespectfully or abusively
- Fraud or misrepresentation is suspected
- Payments are not completed
You may also terminate services at any time, but no refunds will be issued for work already performed.
- Website Use Terms
Users agree not to:
- Engage in illegal activity
- Upload harmful code
- Attempt unauthorized access
- Copy, distribute, or reverse engineer site content
All content is owned by Berkshire EA Tax Advisors.
- Governing Law
These Terms are governed by the laws of the State of Florida, regardless of conflict-of-law principles.
